  • Unfair business practices
  • Breach of fiduciary duty by officers, accountants, and key employees

Trademark and Service Mark Infringement

Small businesses work just as hard as multinational corporations to develop and secure their intellectual property in the form of trademarks and service marks. The goodwill that your business has created and maintained through the use of these marks is a tangible business asset that can be worth a great deal of money. It’s important to zealously protect your marks. Once your trademark attorney has gone as far as possible, it’s time to turn to a litigator who has handled trademark matters. Counsel with this type of litigation experience can produce efficient results.

Trade Secrets and Employment Contracts

Key employees at all levels of the organization will necessarily come into possession of important information about your business, its clients, and its business practices. Many companies seek to protect their competitive advantage through the use of employment contracts with non-compete restrictions that prevent employees who leave the firm from working in a competitor firm, or starting their own firm, and using your proprietary information. While this is a reasonable strategy when done properly, a poorly-drawn employment contract can backfire and lead you into the courtroom.

Representative Cases

  • An oil company fraudulently misstated its income when purchasing a smaller gasoline company. As a result, the gasoline company was not properly compensated. The gasoline company filed suit and successfully recovered for the actual value of its business, $435,000.00.

  • A young couple purchased their first home and had it inspected by a national home inspection company. Multiple problems developed in the home shortly after they moved in. A consumer fraud action was filed against the company which was ultimately heard by the Appellate Division of New Jersey. The couple received two and one half times their actual damages and reimbursement of their counsel fees.

  • A taxicab company operating in the tri-county area in South Jersey as "Yellow Cab Company" became involved in litigation with a competing taxi company, which sought to use the "yellow cab" name and which was also violating a contractual agreement not to compete. After a trial in the Chancery Division of the Superior Court involving issues of trademark infringement and non-compete contracts, an appeal was taken to the Appellate Division. The Appellate Division enforced the rights of the Yellow Cab Company to exclusively utilize the name.
