Divorce

Our lawyers handles divorce and legal separation in the state of New Jersey. There is no specific rule on how long the divorce process lasts. In general, it is rare for the divorce process to reach a full and complete conclusion in less than ninety days and some cases can remain pending for six months or more. The length and complexity of a divorce case is often directly related to the issues and the willingness of the parties to work collaboratively and reasonably with one another to achieve a just and fair resolution.

Child Support & Child Custody

The concept of custody is generally composed of two sections - legal custody and physical custody. Legal custody generally refers to major decision-making authority and responsibility for day-to-day activities. Physical custody generally relates to the time the child spends with each party and is often interchangeable with the concept of parenting time. Ultimately the decision regarding legal and physical custody is best left to both parties to decide. In the event that both parties cannot reach a decision, the court must decide what is in the best interests of the children.

Spousal Support

Support is comprised of two areas - child support and spousal support. In general, child support is determined by state guidelines, which determines a certain amount of support based upon a variety of factors, such as income, daycare, health insurance and parenting time. The amount can be modified upward or downward in some instances depending upon the specific facts of the case. Spousal support is awarded depending on the other spouse's income and the lifestyle of the parties.

Equitable Distribution and Property Rights

Unlike other states, New Jersey does not automatically evenly divide all property acquired during the marriage. A complex series of statutory criteria must be proved to receive any share of property.
